Personal data subject: stated when the consent is accepted.
I consent to ByFly Group LLP (BIN 261040023460, address: Республика Казахстан, г. Алматы, ул. Айтеке би, д. 100, н. п. 71) collecting and processing the GPS tracks of my device while I work in the ByFly Taxi service — when I am on the line and when I am fulfilling an order — to calculate traffic and improve routes.
1.What is collected: coordinates, speed, direction of movement and the time of each point. Off the line and outside an order, tracks are not collected.
2.Why: to calculate speeds on road sections and travel times by hour of the day, and to improve routes and the map. Tracks are matched to roads and used anonymised — without name, phone number or car number. Tracks are not passed to third parties, except where the law requires it (courts, law enforcement bodies).
3.Where they are kept: on servers in the Republic of Kazakhstan. Tracks are not sent outside the Republic of Kazakhstan. Tracks are not published or disseminated in publicly available sources.
4.Term of the consent: while the agreement with the driver is in force or until the consent is withdrawn.
5.Retention periods: tracks on the line without an order are kept for 30 days from the moment of recording and then deleted. After that only anonymised speeds on road sections remain — without my identifier and car number and not joined into a track; this is no longer personal data, and it is kept without a time limit. If an incident, a complaint or a request from a state body falls within this time, the tracks are kept until the case is closed. Tracks of trips on orders are needed for the trip itself and are kept under the agreement with the driver — 3 years after the end of the year of the trip; for traffic only anonymised speeds are taken from them.
6.The consent is optional. Without it I work as usual: I go on the line, receive orders and use navigation — my tracks are simply not used for traffic and routes. Geolocation for matching orders, navigation, price calculation and trip safety is processed under the agreement with the driver, not under this consent.
7.Withdrawal: in the app, in the "Documents and vehicle" section, or via the contact of the person responsible for personal data processing (директор ТОО «ByFly Group», info@byfly.kz). Withdrawal does not limit my work: from that moment my tracks are not collected or used for traffic and routes, and tracks already collected for this purpose are deleted within 15 business days.
